In 1825 Malone was in debt to Wagley and Caldwell. They sued
and obtained a judgement against him in the Adair Circuit
Court, but it appeared he had no property. Malone also owed
money to the Bank of the Commonwealth which also recovered
a judgement against him in Adair Circuit Court and they levied
on 50 acres of land which was part of a tract owned by him
that contained 146 acres. The land was sold to Parker C.
Hardin and William Butler purchased the remainder. William
Butler, Jr. is mentioned in Malone's answer to the charge.
William Butler sold the land in question to Elkanah Butler.
An amended bill, dated 29 Jun 1827, stated "since he filed
his original answer "William Butler has attained the age of
twenty one..." J. Walker was guardian of Butler."
