I Joshua Weakley of Montgomery County and State of Tennessee, being weak in body, but perfect in mind and memory do this twenty eight day of February in the year of our Lord, One thousand eight hundred and twenty four, make, publish and ordain this my last will and testament, revoking all other wills by me made, and is in manner and form as follows: First. It is my will and desire that my beloved wife Mary Weakley be allowed to live on the place I now live on, during her natural life or widowhood and that she be allowed to keep for her support and the support and raising of my children, what of my household goods and kitchen furniture may be necessary. It is also my will, she be allowed to keep what of my farming utensils, such as plows, hoes, etc as may be necessary and as much of the present crop, and meat sufficent to support her family one year, also my young sorrell mare and my gray mare, one yoke of steers and one cart, also 4 cows and calves and thirty head of hogs. It is also my will that at my death, the negro girl Jude be retained in the family to aid and support my wife in raising my children. It is also my will that the negro boy, Lewis, be exchanged for another boy, fully authorised by my executors, to advance the difference in cash ouit of my estate or he may be exposed to take as my other property and another boy purchased with his price, as my executors may think nost right, both of these negros to remain in my family during my wife's natural life or widowhood, at my wife's death or intermarriae the whole of my property, above named shall be sold and the money from the sale thereof equally divided amongst my children. Should my wife intermarry with another husband, she will be only allowed to draw a child's part, every specie of property above named shall be sold on a twelve month credit. Bond with good security taken and the money arising from its sale made thereon shall be divided equally among the whole of my children, my wife's part first taken out of the amount of the sale, first observing that my children be raised and educated at the expense of the whole estate and not taken out of the child's part, and that all of my just debts and funeral expenses be immediately paid. It is further my will and desire that the money arising from the sales of my property over and above the payments of my just debts and the using and education of my children be kept at interest until my children become of age, and as they come of age, will be allowed to draw their part. It is also my will that at my wife's death and all of my children of age, my land be sold, and equally divided amongst my children as the other sales. Lastly I do hereby authorize, nominate and appoint my worthy friends Wm. Morrison, John Parchman and my son James Weakley, Executors of this my last will and testament.
