"I, Robert Weakley Senr. of Halifax County and State of Virginia, being of an imperfect state of body, but of a perfect mind and memory, thanks be to God; knowing that it is appointed for all men once to die, do make and ordain this my last will and testiment, that is to say, principally and first of all I give and recommend my soul to God that gave it and my body I recommed to the earth to be buried in a decent Christian burial at the discretion of my executors, nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God, and touching such worldly estate wherewith it has pleased God to bless me in this life I give devise and dispose of the same in the following manner and form. First, I lend to my beloved wife Elinor, during her natural life or widowhood the plantation and tract of land whereon I now live, containing six hundred and sixty six acres as will appear by a plat made by my son Samuel, also all my household and kitchen furniture and plantation utensils also five negroes by name Jess, Hampton, Jack, Celah, and Jim, also my cart and oxen and still, also her choice of six hoggs, also a gray horse and bay mair and colt and all my stock of geese; but if she should marry, she shall be disposed of all and everything except the negro maid Celah and her horse, saddle and bridle and one bed and furniture which she shall have during her life. Also my son Thomas with the estate already given him, I lend him the negro by name Abraham until his son Thomas is sixteen years of age at which time I give and bequeath the above mentioned negro to his son Thomas; but if he should not survive to the age of sixteen, I give and bequeath the negro to his brother Samuel. Also I give and bequeath to my daughter Mary, twenty shillings, together with the estate already given her. Also I give and bequeath to my daughter Jane all of that tract or parcel of land which lies between the tract where I now live and Fleming Hodge, Thomas Bush and the tract of 100 Acres I gave to her husband after making the tract I sold Bush, 200 Acres, together with the estate already given her. Also I lend to my daughter Martha, during her life fifty pounds and at the death of her mother I lend to her the negro wench Celah and at her death I give and bequeath the fifty pounds and negro to her son Thomas, together with the estate already given her. Also I give and bequeath to my daughter Isable twenty shillings together with the estate already given her. Also I give and bequeath to my son Robert at the marriage or death of his mother the negro by the name of Jim, together with the estate already given him. Also I give and bequeath to my son Samuel at the marriage or death of his mother all and every part of the estate which I lent to her, except the negro Celah and Jim, which I have disposed of as appears above, together with the estate already given him. Also I give and bequeath to my grandson Thomas Parker, twenty pounds. Also I give and bequeath to my granddaughter Betsy Hatfield, twenty pounds. Also I give and bequeath to my granddaughter Rodah Parker, a negro child by the name of Charles and twenty five pounds. (the part that later became Mississippi County, where Isaac's son Samuel lived) Isaac Weakley is shown with his wife and one male person, age between 20 and 30 years. There was another Weakley family there from Kentucky and it is difficult to know for sure, but the person shown in Isaac's family may have been the John M. Weakley, who purchased Lot. No. 1 in the town of Charleston, Scott. Co (now Mississippi Co) on July 12, 1837, from Thankful Randol (Scott Co. deed 6 p 193. Also recorded in Mississippi County deed Bk B p 242). Isaac married in Davidson Co, Tenn. to Mrs. Mary Lee on Sept. 19, 1842. It would appppppear that Isaac's first wife, Sarah McGaugh, died while they were in Missouri." Oct. 22, 1840.

It is my will that my nero man Jessee have all the coarse cloths. Item 11. I give and bequeath to John S. Major all the money that may be on hand not heretofore given away in this Will out of which ballance he may pay any just debts, and lastly I do hereby nominate and appoint James H. Major Executor of this my last will and testament, hereby making and declaring all other wills or parts of wills heretofore by me made, void. Know ye that I, William Wakley for and in Consideration of ye natural love and affection which I have and do bear unto William Weakley, son of Robert Weakley and allso for other good causes and considerations, me these unto moving having given and granted and by these present do give and grant and conform unto the sd. William Weakley, son of Robert Weakley, a certain quantity of goods &c. I do give my hors and sadle and one pare of iron tongs and six larg prueter soupe plats and one Pewter Tankert, thes I do warrant and ye same in what place or places so ever, ye same shall be found as well in my own ausbody or possession as in the possession, hands, power and custody of any other person or persons whatsoever of all these goods and chattels ye schedule have to annexed to have and hold. Witness: Griffith Rutherford Signed William Weakley Sept. 23, 1752 proven and recorded Dec. 7, 1757 William Weakley died during February or before March 6, 1753. Letters of Administration were issued to James Stewart March 6, 1753, with John Stewart and clement Read as securities. On the same day, David Caldwell, John Logan, Christopher Parsons and James Rutherford were directed by the court to appraise the slaves and personal estate of William Weakley deceased. They reported on October 18, 1753 (will Bk 1 p 112) that the estate of Wm. Wakely dec'd was as follows: "One roan mare, one chest, one indian blanket, 3 books, one handkerchief, one pair of sheets, 1 bedgown, 2 old shirts, one old coan, and jacket, 3 pewter dishes, 6 plates, 10 spoons, 1 shovel, 2 blankets and many other small items and about 100 shillings in money." On April 3, 1753, letters of Administration were issued to Robert Weakly for Wm. Weakly dec'd and the same persons were directed to appraise the estate of William Weakly, dec'd. On Oct 4, 1757 Thos. Bedford, James Taylor and Thomas Bouldin, Gentlemen, were appointed toe settle amount current of the estate of William Weakly dec'd, whereof Robert Weakly is administrator. On June 7, 1763 (Lunenburg deed 9 p 158) Robert Weakly and Thomas Ward sold the William Weakly plantation plus other adjacent land, a total of 526 Acres, to John White for 370L. This deed was signed, Robert Weakley. On June 9, 1763 (Deed 9 p 229) Elinor Wakley, wife of Robert Wakley and Elizabeth Ward, wife of Thomas Ward, relinquish their dower rights to the land."
